I'm going to feel stupid when someone explains this, but I'm not seeing the problem here.
Supposing the 8-ball lies some of the time, it can simply be lying in this case.
It's not a logical paradox in the same vein as "This statement is a lie."

Yeah, you think you're so smart - but how then do you know when to trust the magic 8 ball? I suppose you could ask the thing if it is trustworthy, but what if it says "no"?
