You aren't stealing from a third party like you try and make it out, oh are you one of those dudes that keep buying the SAME album over and over because the Media got messed up, look at it this way, I used to work for a college and we had to upgrade to XP(a while ago) we have over 1000 computers, do you think our distrubtor sends up 1000 retail boxes? No we get a License for 1000 and they ask us how many disks we need, say we want 50, they charge us for the disks like 5 bucks each, and if we need more for whatever reason just call up the distributor and bam they send them out. Same with music "The License" is the original disk, as long as you only have that content "however you get it, your OK

OK I walked into that, but literally I don't think it's "theft". I know it's illegal, and there are most likely official terms used to describe it, data piracy or whatever. I'm not saying it's legal, or right. Just that it's not theft.

For what it's worth, I question the moral and legal arguments that say people can't download music, regardless of whether or not they've bought it previously. I have a serious problem with the RIAA telling me as a Canadian that I can't obtain music from some Finnish band who aren't even signed to an American label. The only people who have the right to tell me I can't do that are the Finnish musicians whose music I want to download.
I also SERIOUSLY don't like the recent mutterings (ridiculous on its face as it may be, it's still a sinister start) that making copies of stuff you actually do own -- for instance, ripping a CD so you can listen to it on your iPod -- is unacceptable use. I know they aren't going to get anywhere with that noise, but it pissses me off that someone even thought to say that.
None of that is relevant, however. The question was "Is this legal?"
The answer is "No, it isn't"
And yes, it does depend on where you live. I'm not sure if they've changed it (they threatened they would) but in Canada we pay a levee on recordable media which ostensibly goes to cover whatever royalties / fees / copyright kickback is necessary when we make a copy of something. Under that idea, we are allowed to make a copy of anything we purchase or are given (provided we are given an original copy), and are therefore allowed -- technically -- to download anything we like secure in the hilariously bogus belief that we are simply availing ourselves to a copy of an original. We're not allowed to offer anything for UPLOAD, on the other hand. Which would probably make us the pariahs of the P2P scene if we actually followed the law in this regard.
As far as the idiot nature of this thread goes, it's pretty clear to me that what is being sought is some kind of moral support, and to be honest who the fuuuuuuuck cares? You want to download shit, that's between you, your conscience, and the laws of wherever you live. That equation nearly invariably comes down on the side of "well, hell, I'll download it then" without the need for justifications, discussion, stories about how you keep every receipt from every album you ever buy, and other irrelevant mumbo-jumbo like that.
You asked if it's legal, it ain't. You asked "well, in this specific circumstance where I actually DID own the stuff legitimately, is it legal" and it still ain't.
Does the legality even matter in this situation? If I say it's illegal, will that change your mind? If you thought it was immoral to do it, but I told you it was legal, would that change your mind?
