That would be entirely up to Eidos. Personally I doubt they would care (and suing their own fans is likely to do more harm than good), but they possibly have a right to demand that the individual FM is withdrawn if it uses Thief material or characters.

I also can't see the point in arguing against the mod. Whether or not I've worked on it. Why would someone who likes to play thief have any problem with anyone making thief like mods?

I also can't see Eidos goin after an author if they did use Garrett or the Hammers. Is Eidos even gonna waste legal money sueing one broke thief fan? for what purpose. It would probably cost them more time and money than they'd see out of it anyway. Did they sue Purah for using Lara Croft stuff in Calendra's Legacy, one of the largest and most popluar T2 fm's?

I think something has to be said because various people have brought this same issue up over and over again in spite of the evidence brought forward from multiple sources that there is no copywright issue and even if it was it's NH problem not ours. I get the sense that there are those out there who want to see the Dark Mod go under either because they want to keep things the same or perhaps they don't like the idea of a potential growth in the community that isn't under their thumb.

While this in no way has a bearing on the Dark Mod's legality, I have to say your analogy is seriously flawed. It seems that not being genuine commercial products matters (although something similar was done in Russia and became a national bestseller, I think).
As for bringing up this matter on a shareholder meeting... really, do you think they will care once they stop laughing?

All that aside, is there any even idea as to when this mod would be for public viewing? 2008? 09 10? Dark mod keeps me awake at night, I'm way too excited.

The unofficial estimate for availability of the Kit is end of 2008, I believe. Like many software projects, however, that date may slip, but I for one will not hold that against the team if it happens, and will continue to wait patiently and think them when it's done. God knows most of my missions have missed the target release date I set for myself.
