Creative Labs, in a purely douchey move, patented the technique 'after' hearing about it. They then 'allowed' id software to use this technique if they bundled EAX into doom 3.
The technique had been clearly explained well before Creative had even filed the patent, but the courts sided with them for whatever reason. Details here.
Anyway, it appears that Carmack has had enough of Creative Labs dicking around and messing up the source code release. So, he rewrote the code....now the D3 source code can be released.

Personally, I'll never buy another Creative Product again if I can help it.
I didn't forget how they threated a person who wrote some drivers for xifi. I bought many sb cards but I don't support since then. This situation also proved me I did right decision.

Unfortunately, because of patents (again), almost every non-Creative audio device (including most integrated chipsets) must pay royalties or licensing fees to Creative. If your PC has sound it's likely you are helping extend the legacy and wealth of Creative. :(

Why would all sound "card" manufacturers pay Creative? It isn't like converting digital data to analog waves is a new concept or anything. Here's a ZX Spectrum from 1983 happily playing sample-based music. (
