A discontinuity would be if they took something they laid out as law about the character in the first movie, and completely ignored it in the second. Recasting an actor isn't a discontinuity within the movie, as she would have always looked like that to the other characters anyway. Now, if they changed her name to bitzy, and tried to pretend she was the same character...even though we all knew that wasn't her name, then that would be a discontinuity. What you're talking about is casting, and it exists outside the world within the movie. For all intents and purposes, Maggie is the same character Katie played.

But it's almost like they said, "Well, we need someone who looks like Katie Holmes," and she does, but not in a good way.

This. Katie Holmes has always had this doll-like look, and in
Thank You For Smoking she looked pretty much like a badly aged doll. She's pretty much one-note and, as far as I'm concerned, terminally uninteresting. I definitely don't see any problem with them putting a good, interesting actress in the role.
Added to which, I do think Maggie's much cuter than Katie.

I guess Maggie's looks are of the love-'em-or-hate-'em variety. As I said, I find her considerably more attractive than Kewpie Doll Holmes. Still, my favourite female lead in a Batman movie will always be Michelle Pfeiffer (love her Catwoman!), but she wouldn't really fit in the Nolan Batman films, nor would the character design.

I'm a little distressed at some of the art direction (particularly the way Gotham seems to be all Batman and Robin) and I still think the Joker looks disappointingly like a soggy mime, but on the whole this film still looks like it's head and shoulders above every Batman movie that didn't have Michael Keaton in it.

Agreed, more or less.
I'm still not entirely sold on Ledger's take on Joker. His line readings are coming off a little wrong, a little too, well, serious, even with the silly voice. Joker's supposed to be having fun, even if nobody else is.
Having said that, I'm still willing to give him the benefit of the doubt. I'm guessing his take on Joker will play better in context of the film as a whole.
This trailer is actually pretty terrible, all explosions and fast cars and Joker one-liners delivered sans zing--in other words, not particularly Batman--but I'm again willing to give the film itself the benefit of the doubt since blockbuster trailers are almost always appalling.
