Don't be dense, they don't have a choice. They only hold the North American distribution rights to most of their films.
The likes BDs from big studios are usually region free because they hold rights in multiple territories or globally.

Calm down mate, I wasn't at all serious in my call for Criterion to 'get their shit together', hence the :p. What I meant was "until there are more of the films, like the kind Criterion distribute, being region free, I won't be getting a PS3" and I probably should have said that :p. Completely off topic, but I figure you of all people would know and my searches haven't turned up anything; are any of the Herzog/Kinski films on Blu-Ray or looking to be available on it?

None that I know of, Anchor Bay/Starz hold the rights to a few so they might get put out eventually (that is if they ever get tired of re-releasing Halloween and the Evil Dead trilogy).
