I tried both ways (with and without finding the indictment before taking a bath) of ending the mission now. It appears as if the mission cannot be completed when one first takes a bath and looks for the indictment afterwards, but it can.
The normal sequence of events is that the player achieves every mandatory objective, including obtaining the indictment, before even going into the crypt. Once the outer door of the crypt has been opened, there is the inner door, which can only be unlocked by using a special key on the uncommon lock in the wall before the door. In the room beyond, the player has to frob ("use") the mask of the statue and find a note from Anna D. (the witch) below the stairs leading to the pool. The face of the mask looks at that spot once the player frobbed it. The note should be taken and read in order to tick off an objective; I think it's "Find out what Anna D. meant in her note". The player may then proceed to the last room here, where a nice bloody bathtub awaits. Jumping in causes Elizabeth to be teleported into the area where she can (and should) take Belial's sword, which then teleports her into her suite, where the mission ends.
Now let's assume the player did everything required except for getting the indictment, and arrives at the crypt. If the player now looks at the special lock on the inner door to the crypt, an onscreen message will appear, suggesting to finish required objectives first. But the player can still continue, find the note from Anna D. (the witch) in the room beyond, and proceed to take a bloody bath. Elizabeth will appear in the area where she can take Belial's sword, and taking it will bring her into her suite. This is, in fact, the end room. But since the indictment is not yet found, the mission will not end - yet. So, the player has to get the indictment and return here.
The door to the outside of the suite cannot be opened anymore now, but there is another way in and out of the suite. In the bathroom, there is a coathook near the bathtub. The coathook can be turned to open a wall panel, giving access to a way outside. Elizabeth can then retrieve the indictment and go back into her suite using the secret passage, and once she arrives in the right room of her suite (I think it's the bedroom, but just try every one of the rooms - one should work), the mission finally ends.
This actually makes sense. Elizabeth has to commit suicide after completing the mission in order to start a second life as an undead being, and she intends to do this in her bedroom. I just don't know whether the readables in the mission suggest it well enough at that time, or whether only the next movie clears this up.

I intended to do so myself but RL got in the way, but I doubt if I would have discovered the coat hook to escape the bedroom so would have spent endless hours seeing how we could have sorted out Marbrien's issue.

I discovered the coat hook only because I was looking for it - I came from the other side originally and thought, "there must be a switch on this side as well". And as for RL issues - well, mine happened a bit earlier, so I was able to devote time for this yesterday. One day before that - no way.
Which remains me I still have to do some research concerning "Calendra's Legacy". Turned out amulet building there is buggy/unstable, but not because of the DMLs. But that's another story for another forum thread...;)

I'm replaying this mission and having a big problem in the chapter "Fallen".I killed Ponikenus and 2 of his guards, but am not able to enter the Morningstar area again without being killed by something out of the blue. How do I move on from there? Playing on expert. Please help.

I don't remember where the Morningstar area is, but perhaps you can still figure out how to proceed with the following.
Did you realize that some things there have a blue aura that is holy, and damages Elizabeth? You can go around some of these auras, but if that does not work, you have to destroy them with a fire spell or perhaps with a sword (says fortunis walkthrough, I only used the spells). Some of the objects with the auras are hard to see from some angles, and it might appear to you that something kills you without being visible.
Furthermore, I wrote down that there are archers in the area where you kill Ponikenus. These archers fire arrows that also create holy auras, so one of these could also have appeared in an uncommon spot there.
One place where you can flee from this area is a hatch before Katalin's cell. It leads to a lake through which you can swim, and there should be a place near the shore where you can climb up and follow a passage to a location just before the castle. You might have to look around a gate for the opening mechanism, but then you should be in an area again where you have been before.

I did all of that, was everywhere, but it's no archer who gave me the "deathspell" up there. I'll try a earlier download.

I'm sorry, but something is wrong here.
I killed the guards op there, killed Ponikenus, while luring him back down the hill, took the spell off the chest, but whenever I get back to these grounds, I get killed, by an atmosphere, is it the morningstar? I already put the sphere arrow where it should be, but I need that special key to open up the lid to Katalin, but I never can get the key from the chest without being killed. I'm dying here, after so many tries!!! :confused::nono::o

Luckily, I had a savegame just before dealing with that area, and could finally find out what really happened here. Your problem most likely is that Ponikenus has seen you while you were approaching. If he sees Elizabeth, he will try to cast a spell at some blue sphere which is mounted on some kind of upside-turned-down stone claw inside the building there. This spell enlarges a holy aura around the sphere so much that it extends outside the building. You need to run through that aura and get to the other side of the building, where Ponikenus once was - or load an earlier savegame and try another approach at Ponikenus and his guards.
If you cannot survive running past the building because of Elizabeth's damaged health, you have to return to one of the white "things" which heal Elizabeth. One such thing is in the castle's kitchen, another in the armoury below the castle. A third one is close to where you are now. Open the gate near the bottom of the ramp with Thurzo's keys, then go through the passage behind the gate. It leads to the mill, but somewhere there, you should find one of the white "things" which can heal Elizabeth.
Once you are strong enough to get to the other side of the building at the top of the ramp, you have to fire one of Elizabeth's fire spells at the blue sphere in the building. That should destroy the aura here. Go back to your preferred healing place if you like and come back. Approach the chest behind the altar and destroy the holy water flask with a spell, then take the key out of the chest. Use it to open the hatch in the building and proceed to Katalin. Beware of the next aura...
