IANAL, but I would think that an engine remake should be on a slightly better legal footing than a complete remake - if you require the original game data then ostensibly you aren't trying to give away any copyrighted stuff. Doing a complete remake might yield an improved game but then you'll likely have to deal with EA's lawyers (anyone remember AlienTC for Doom?)

build does not have dynamic lighting. i should know, i screwed around with it for 3 years. kinda puts it behind SS1, if you think about it, which DID have dynamic lighting. build also does not have TRUE room over room, however later versions fake it by first having a room with a hole in its floor, another room with a matching hole in its ceiling, and texturing the hole with a special texture, and altering the properties of the holes' sectors so that they are linked. in shadow warrior this worked quite convincingly; in blood, the enemies on the other side of the hole couldn't see you, so you could snipe them with impunity (good example being E2M1.) however, even the original version (duke3d) allowed for different sectors to cross over each other as long as you never saw both sectors at the same time. build does allow for sloped floors, and i imagine they're done in the same manner as SS1's sloped floors- start off with a flat floor, and tilt until satisfied.
also, btw, the aliens TC for doom, amazingly enough, has never ever been foxed. you're probably thinking of the QUAKE TC (which was where the term "getting foxed" comes from.)

Zod Wallop: If the team doing SSHP hadn`t stopped without notice, that engine would be ALOT further along by now however. They pretty much had the levels down, and were working on cyberspace and AI when it all stopped abruptly if I remember right. Real shame too as it was really starting to look good.
Shame a team didnt pickup where they left off either, but ah well.

Perhaps my memory is faulty, but I was sure that AlienTC got foxed as well as the Quake one. Oh well.

From what I recall. None of the Aliens TCs for Doom ever got Foxed. The first aliens TC to get foxed ever was the Quake TC.
