i made a mage with good stat points and he cant cast any spells even though i have runes in my book and the fireball spell in there and i got a high casting level and a high mental...

Are the spells failing or are the runes just not being understood by the game?
Be aware that there are areas where you cannot cast magic, usually posted with signs in the area, spells in those areas always fail.
While I've got some issues with the game, I can't say that it's as bad as you make it sound, details on the problem, maybe someone can help you solve it (stat numbers, what's happens and where you are when you try to cast, what you try to cast, etc.)

i got a casting of like 75 and a mental of about 22.
before i could easily cast ignight but now i cant i think it may have been after the new patch it happened. cos before i just used the version from cd and it worked fine.

ok i know how to cast the teleport spell think when near those round things on each level and when i press control i do the correct ones,
the one that goes in a straight line up and the one where he says sparsoo or whatever. but it dont work and that is crap for when i cant get of the place where the hell hound chases me....

So, you're in the dwarven area with the big dog thingie? No magic there... it's a no-magic zone.

There's 2 ways to do the Shany quest, either way you have to go on level 5(or is it 4), at some point you see a cutscene with some cultists walking. You have to follow them withouth being seen or Shany will die and then you have to kill them, when they reach the place where Shany is, or Shany will die. Anyway it took me a few tries before I got Shany to ... not die.
I like the fact that the game is open ended but it's easy to get too far ahead and miss what you're supposed to do next. The problem is that unlike other games, such as Baldur's Gate, there are few side quest and a "larger" main plot that is, for the most part, linear. It's easy to "jump off the tracks" of the main plot (by killing an important character for example), and once that happens there's pretty much no way to undo things and get back in the plot besides loading a saved game (or restarting from the beginning in the worst-case scenario). While it should still be possible to finish the game after you got the plot "out of the woods" (or even if you kill every single thing that moves), there's not much point in doing it as you miss the entire storyline, and all the quest xp. I hope they are more careful about that in the second game.
How they could do that is anyone's guess. Preventing you from attacking certain characters? Giving you a "game over" when killing certain characters (like if you attack a keeper when you're allied with them in thief 3)? Or a solution that might appeal to more people is an "autosave" feature that makes a save after every important main plot event. That way you could "go back in time" when you get the plot's "knickers in a knot".
Being able to do almost anything you want does add to the believability of the game world though. Even though some options may not be desirable the fact that they exist as options is enough to male you feel more free and get immersed in the game. Sure you're supposed to "do your duty" as a guardian and go fight the evil Akbaa... but you could also say "screw all thoses people", go murder the king, take his keys and walk out of thoses damn caves to freedom. (You may not like what you find outside though)
