You'd have to also note that those responsible for getting it running also couldn't charge to do so; if they did, you'd get into messy IP legal fights very quickly.

I feel that in many cases fans of the game have done a far better job at keeping the game alive and running than the actual rights owners, so any result from this that would make it even a little bit easier would be a win in my book.

That's not part of my suggestion, no. Once a company
wants no part of it, they
get no part of it. What anybody else does with it, isn't their business anymore, by their own choice.
Still, if that could get passed and my suggestion couldn't, it would at least be a step in the right direction that isn't present now.

Looks like the initiative has succeeded in getting the necessary signatures -- 1.4 million should be enough to account for invalid/fraudelent signatures.
However, there's been some highly suspicious anonymous accusations filed against the initiative and it seems that the games industry is gearing up to lobby against it.
