Also, I think the "stolen" flag should vary from item to item. A common spoon shouldn't be as easily recognizable as "stolen" as a rare, powerful weapon would. Also, if you DO get caught stealing that common spoon, they shouldn't react as harshly as they would if they caught you stealing their best armor.
Next thing I know, I'll accidentally touch a spoon, a pillow, or some other mundane item and hear some crazy asshole yelling random insults with a blade drawn!

It may have been their
favourite pillow or spoon. It is also a bit silly that if you nick something out of sight of anyone all guards across the land instantly know you stole it and get you to pay a fine. I got so incensed once that I slaughtered everyone in Ald-Ruhn...

I`ve been thinking for some time about what rules I must abide by to play a Garrett style thief. I`ve imagined some problems though. For example, the knockout system was dreadful in Morrowind. The npc would get up within only a few seconds and renew hostilities straight away. hopefully they changed that. I was thinking of enchanting a club with `sleep` spell, but now it seems we must join the mage`s guild for that.
The other one is whether to join the thieves guild. Clearly Garret would not, but at the same time he has fences and contacts that the game will only provide via the guild.
However, I have learnt from a friend that playing Elderscrolls games with self imposed restrictions (actual roleplaying) makes things much more fun.
I`ll probably play a thief third, as you tend to find out about secret areas/items more. And the temptation for subsequent characters to exploit this knowledge is too great.
EDIT: I heard that they didnt fix the spoon crap. The worst experience for me was immediately after becoming Morag Tong boss, then having all my underlings attack me over touching a cup. I`m the Godfather. I own them and their stupid cup!

That's a very interesting thing to say. I'll probably play first as my usual Battlemage, or Spellsword, I don't know which is which--a Mage that is also a master swordsman--then give a Thief a try. I've never actually devoted that much time to being a Thief in an Elder Scrolls game. I'd play with it for awhile then give up. But the thing your friend said piques my interest. I'll stick to it a bit more this time, worry less about leveling and such and more about
becoming the character.

That would be a good thing for the Thieve's Guild to provide as a perk, wouldn't it? It could be more Thief like in that it only works if you club them unawares, but that sounds like too much to hope for.

It might be a nice idea to use persuasion skills to bluff merchants to believe your stolen goods aren't stolen. Same with guards. Fooling people would be harder when item is more valuable. Possible addition to Elder Scrolls V wish list. ;)
Oh, and as far characters go, I'm torn between mage/warrior hybrid, tief/mage hybrid or an all around generalist character. (not that anyone cares...)

Of course we care, Mercy Dealer. I'll start as a mage/warrior too simply because it's more straightforward and gives you a taste of everything Oblivion has to offer. But I really do like the idea of restricting your own character and possibly enjoying it more. I've never played that way and I want to give it a try. But probably not till my second time around. So pure Thief for me (if their thief class really is a lot better than it was in Morrowind) and no Mage. Whew! That'll be tough.

I had a lot of fun with my Argonian show-off swordmaster. In short:
Charisma bomb (my Morrowind char ended up with CHR 172)
Speechcraft (for Monkey Island style mêlée)
Long Blade (light and quick ones, for cutting "Z" into the opponent's clothes)
No Armor (armor would only hide my own shiny clothes)
Acrobatics (for jumping on tables and/or chandeliers)
A little Illusionism and Alteration for the flashy effects and openening locks, a bit Restoration for pimping stats.
Two weapon combat would be awesome for him, and I dearly hope they included the "enrage humanoid" spell again. And if my fancy clothing actually would impress people this time, well, that would be nice. :P
So, not a thief at all I guess.
