Any situation where a bunch of people sit there and actively cause the death of a helpless person who does not wish to die...fuck, what would you call that?
It's a fundamentally "eye for an eye" punishment. There are far more humane, non murderous alternatives (like life in prison), so essentially you're killing someone entirely because they killed someone. And in many cases, you're sitting and planning vastly in advance the killing of someone that didn't sit and plan in advance the killing you're executing them for.
Just because this sort of barbaric punishment goes back a long way historically, it seems more acceptable than it should. Imagine if the punishment for breaking someone's leg in a drink driving accident was to have a state-endorsed stuntman smash your leg by highspeed car collision? If getting in a fight with someone that left them blind in one eye meant that they (or a court appointed tough dude) got to punch you in the face until you too lost an eye?
It's just...a stupid, misguided, idiotic and wrong way to do things.
Scots: yes, and war is fundamentally fucking stupid, but it's an entirely different kettle of fish.

Depends on the situation. I can envision at least 3 scenarios which are completely different and yet which all involve exactly what you've stated.

The time frame has nothing to do with it. And how do you know this murderer didn't plan everything, and for longer than the state has planned to execute him/her? What difference does it make anyway? If I plan to kill someone over the course of a year or decide I'll do it in 20mins are they any less dead and am I any less a murderer?

Heh, I remember speaking to a police lawyer on the train one day, and she told me that they locked up noticeably more prisoners during winter then summer, something she put down to people "wanting somewhere warm to stay".

The US have lots of money to spend on shitty ideas every time a president needs to get all tough guy starting a war on a minor country. And people buy that. But when it comes to choosing between a few criminals' life and death the same people get riled up about the tax payer's money.
