I see a good possibility for this to be handed over to a state court, as the Army is within its rights to do. A guilty verdict is guaranteed in this case, as there are both countless eyewitnesses and plenty of evidence that the act was deliberate, not just a result of insanity. Most importantly, it shields the Army from the bad PR that typically surrounds a racial and religiously charged trial(ie, someone's going to be calling bigotry at some point no matter how guilty he is).

I didn't phrase that too well.
my point was that if the army wanted the death penalty or life, they could have him tried in federal court and still be pretty much guaranteed to get that result.
