What if you are like my wife, with a slight tendency towards asthma but who enjoys one or two glasses of wine or a single liquor or whatever on a night out, is she not allowed to go into bars just because you thinking smoking is the same as drinking?

Because everyone who goes to a bar does so with the express purpose of getting drunk, or even just drinking alcohol, right. Even the kids :thumb:

Then why go to a bar at all? Surely there are places to socialize that are healthier for you and your kids. For that matter, I can think of few child-raising habits that are less responsible than taking your children to a place that exists for the purpose of serving adults alcohol. What ever happened to taking your kids to Chuck E Cheese or something? <-- where, I might add, adults can consume alcohol and there's no smoking

For the record, I don't smoke and I had asthma as a kid and being around smoke still greatly bothers me to this day. That's why I avoid people smoking.
The idea that "they should stay within the limits of the law" begs the question of whether the law should be in place or not, which is exactly what we are arguing.
A private establishment should be allowed to let in or not let in whoever they want. If I decided that I would only invite homosexual siamese-twins to my house, that's nobody else's business. If I require that everybody in my house smoke at all times, that's nobody else's business. If I start serving drinks there, the situation does not change. A business "open to the public" is NOT a public service. If a bar decided one night that everyone who comes in has to commit ritualistic suicide to summon the dark lord Zuthulu, it doesn't matter how horrible it is that you can't enjoy the wonderful atmosphere you're so accustomed to and the really cheap drinks because the owner has no obligation to you whatsoever. If they made that sort of declaration after you had already entered the bar and planned on living a good while longer, they can't force you to kill yourself, but if you know that's what is going to happen there you can't go barging in and telling them that's unnacceptable. You can justify health/hygiene standards by saying that customers expect safe food and to provide them otherwise is fraudulent. But if someone opens up a place for copraphagists that serves steaming platefuls of human feces then as long as you don't want to eat shit you should just not go.

Out of interest, can you not get pulled up for discrimination for excluding minorities from your pub? I.e. you are allowed to open up a pub and put up signs that say no queers, jews, niggers, etc. ?
