This topic reminds me of a case I saw on one of the true crimes shows on TV, although I forget what the show was called; perhaps "Forensic Files" or "Medical Detectives."
I only remember a few details, including that the suspect was a native American, and that he opted to swear on an eagle feather instead of the Bible before he testified in court. Anyway, he was accused of rape and murder of a young woman or girl, and his defense was that he 1) found her dead already, 2) for some reason he decided to 'check the oil' of the corpse, and 3) it so happened he jacked off before he went for a stroll and found her body, so the semen the coroners found in the body was off of his fingers. Far-fetched, but it was an arguable defense, apparently. If I remember this right, he was convicted, although I don't recall what the evidence against him was.
Going back to the topic at hand, I think this guy is probably better off playing the insanity card than this, "Oh, I didn't know she was dead, even though she was swimming in her own blood" defense.
