Ugh. If I woke up after a drinking/drugging spree and found a dead body next to me, I'd probably... castrate myself then jump out the window. Yuck, just the thought of doing that :eww: :eww: :eww: :vomit:

(He probably raped then murdered her, BTW. Which is what he is accused of. His defence is that he found the body.)

I like to see the other side of things like this because just occasionally there is another explanation.
Plausible explanations - the guy had sex with the stab victim in Oz but before she was attacked (by someone else) and he could have had sex with this other girl thinking she was just drunk. People have sex with really drunk comatose girls guys, you know this happens. Doesn't make him a nice guy (far from it) but if it did go down like this then what? What should he be charged with? Not rape since she was already dead surely. Hmmm. Tis a difficult one.
All things considered - he probably did kill her imho. Still...

He'd be charged with sexual penetration of a corpse, probably (can't remember if that section of the Sexual Offences Act 2003 is in force yet).

Sexual penetration of a corpse is 6 months to 2 years, so no, not higher than rape.
On these facts at least theoretically you could have him for attempted rape, which would be the same (maximum) sentence - he's tried to rape her, and has basically done so - it's only that she's dead that means he hasn't, and your own mistake of fact making it impossible to commit the offense is no defense.
I know there's a US case on the same point where raping someone only to find out they were dead was still an attempt, haven't been able to find an English one but it's 6:40 and I've not looked hard :P
