what is the legal foothold for mods based on SS2?
does anybody actualy care anymore? well considering Saphire Scar, somebody must. but what exactly is their problem with it.

I'm not exactly sure what your first question means. If you're asking how we have the right to mod SS2, it's basically because we were given the level editor and told to have fun making free stuff.
EA "cares" about SS2 in that they want to keep their IP from anyone who wants to play with it. SS2 Rebooted (or whatever Sapphire Scar used to be) was shut down because EA didn't want SS2 in another engine, as they saw it as a threat to their IP (intellectual property, by the way). It's unfortunate, but it's how the cookie crumbles (for now, anyway).

well my question was concerned with a mod for another game, not SS2.

Of course it depends if you are using protected material and releasing it to the public without some sort of license like a EULA (and it doesn't meet the exception criteria of "fair use", which it probably won't).
So don't pilk SS2 assets directly, and stay away from the specifics of SS2 story, character names and specific types, very specific plot elements ... then you can probably be ok. Just be sure to make it a SS2 "inspired" mod, not SS2 itself.
