Do us a favor and don't try to make the game all at once then release it... rather, release me some dragons... yeah...
err, make the shire, release it... you don't really need to make a big epic adventurer complete with whatever was in those books, rather, make Lord Saurons little house, and have dragons in it =\
Err, make his house and have a fun little happy place for us to run around in and slay things. Then work backwards, as no one cares about some hobbit infested hole... besides, I couldn't fit into it(and would have to murder any halfling who came within sword reach because of that), and there's no phat lewtz in it anyway. Give me the Glamdring(I'd get to kill another elf to!), give me the Mithril ring mail(Though I'd just put it on a shelf since it'd make me look all paladiny...), well, give me dragons at least(and not some trick firework =D)
AS for the copywrite infringment, at least give out the mod before you get beat up by the FBI =D

man... I would make some dragons.. IF i knew anything about 3dsmax. The hardest part would probably be just meshing... then textures... then animation... actually, the whole thing would be tough lol.

Wizardry 8 has "Hobbits." No kidding. I have no idea how they got away with that. (The Hobbit "race" is, has been, traditionally available as a PC choice in the Wiz series.)

On avoiding being foxed:
You could do an "Alien" mod and call it anything but "Alien" or "Aliens." You could call it something like "Intruder" or "Xenomorph" or "Hunter In Darkness" and, well, no problem.
Middle Earth could become something like "Age of Adventure" or "The Rings of Power" or "Wizard Wars."
Really, there's a million of 'em. ;)
Then you change "ent" to "treant," so to speak, just like D&D did way back when. Rinse. Repeat. Etc.
How do you think professional game designers do it? ;)

How do you think professional game designers do it? ;) I can see it now......You play Rodo, a bobbit, who lives in the Mire. You have to destroy the golden ring with several companions, including Landolf. ;)
No, but I do see your point aardvark. Right after I saw that article about foxing, me and the guys Im working with on this sat down and discussed it and decided to work around it some how.
