X360 or PC? If it's a PC version, get the patch from the official site or any of the other places hosting it. If it's X360, erm, help me here guys. Can Xbox Live automatically update it?
EDIT: and Ryushi, I vote for a sticky about the patch in one of the forums.

ive beaten the game 4 times and i havent found any major problems to prevent me doing something and no live doesnt auto update it

Live can do updates, as it does for several games. In fact pretty much any games requires you to update before playing online (to fix exploits and such like).
I wouldn't be suprised if there was a Live patch update but you just didn't notice it, but I couldn't be sure.
The only bug I've had a problem with was on a Thieves Guild mission, where a ring wan't where it was supposed to be. I left the area completely (went to a different city) and waited 48 hours and returned, the ring was exactly where it should have been.
I would have suggested this, however it sounds as though you've been there twice, with quite some time between them, so not really sure what to recommed (crying quietly to oneself usually does the job ;-)).
