Over at 'Planet Elder Scrolls', a site that has many mods for the games, there are some files put up by someone named 'Walthar'. The mods that Walthar has are sound replacements, most of which include sounds from Thief. But nowhere does Walthar state that the sounds belong to Eidos. Is this legal?

Don't ask, don't tell, I'm sure.
In the modding community many people will create items which replicate those from another game, characters from other games, recreate quests, and even sounds. While the legality of such mods can be... put into question, Eidos will largely ignore any infraction unless: 1) Eidos is losing money because of it, or 2) Walthar (or the 'third party') is gaining money because of it.
So long as he doesn't create a clone of Thief using all of Eidos' work as a basis, or he doesn't charge people to use his mod, he should be a-ok.
