Well, it gets a bit more complicated than that, but you're correct that it isn't the LAPD's role to deport known illegal immigrants (in fact Special Order 40 does not even permit the LAPD to make inquiries regarding an arrestee's immigration status). As has been determined by the Supreme Court, however, local and state law enforcement agencies have the capacity to arrest illegal immigrants and report them to ICE solely because they're found to be illegal, though it isn't federally mandated that they do so.

To be specific, the illegal you're talking about wasn't arrested in Los Angeles county, so Special Order 40 did not apply in this case, not that it really matters (he had committed prior crimes and served jail time as you said).

edit: Also, I'd like to clarify in a general sense that there is nothing inherently racist about wanting to squash illegal immigration. I disagree with everything Phide said, but there was nothing racist in his words. What can be racist is the zeal to push these measures through and the resulting atmosphere.

(Such as Cuban-American Camarota) Believe it or not, these folks can actually think for themselves, even without Stitch champion of justice to shield them from the racist dynamism of his fellow crackers.
