To be specific, the illegal you're talking about wasn't arrested in Los Angeles county, so Special Order 40 did not apply in this case, not that it really matters (he had committed prior crimes and served jail time as you said).

edit: Also, I'd like to clarify in a general sense that there is nothing inherently racist about wanting to squash illegal immigration. I disagree with everything Phide said, but there was nothing racist in his words. What can be racist is the zeal to push these measures through and the resulting atmosphere.
