In Canada, there needs to be evidence of premeditation for the Crown to lay first degree murder charges. I believe American law is quite similar, except for the part where David Caruso puts on the Sunglasses of Justice.
States are different, but here the fact that he switched seats at a rest stop so he could sit next to the guy would probably be enough evidence of premeditation for the prosecutor to at least try bringing a 1st degree charge and see if he can find enough evidence to make it stick.

If I were on the jury, then you'd have to persuade me that the reason he switched seats was to kill the man. Someone this loony, I'd buy an argument that he happened to switch seats for other reasons, then went nutty. I'm with SD too, this guy sounds like an insanity defense or the Canadian equivalent is in order.
Regarding being helpful, what I read was that he just whipped out a knife and stabbed the fellow several times before anyone could react. I think the passengers could probably tell the guy was dead already, and you don't risk your life to rescue a corpse. Admittedly, people can survive multiple knife wounds, but if they were to the neck and chest I can understand why people thought of themselves first.

The prosecution's job is normally to convince the jury that the defendant did what they say he did, yes.

I really doubt it'll get to that point. I'd put money on the guy being declared psychologically unfit for trial and spending the next long, long time in a padded hospital room.

It's possible, although he can be insane and still competent to stand trial. We'll probably find out soon.

Shit happens, sometimes for no reason. Actually, there's never a reason beyond personal satisfaction... Mourning is understandable but not necessary for someone like me who will never have to think about this guy again after the story is buried in the next 1000 stories that come out about brittany spears and paris hilton. We'll all forget it ever happened for a while, then sometime later in life we'll be reminded somehow. Life is over-valued by too many in my opinion. The guy is crazy for being able to behead a living human, but it's no more crazy than the preacher down the street telling us how we should live our lives at 2:00AM... It's just a different kind of crazy.
Wow, I probably don't even agree with myself but I'm not going to read what I just wrote cuz I am boring myself. I'm gonna go write a song and dedicate it to this sick fucker... and the victim...

I think, to be more precise, the killer didn't have his head screwed in right ;)
