In Canada, there needs to be evidence of premeditation for the Crown to lay first degree murder charges. I believe American law is quite similar, except for the part where David Caruso puts on the Sunglasses of Justice. The maximum penalty for 1st and 2nd degrees is still "Life" (25 years); the parole interval is 15 years for a first degree sentence and 10 years for a second degree.

From the looks of things, I think they'd struggle even to make that stick. The knifeman is clearly a few fish short of a hatstand, in which case, his legal team may try to argue diminshed responsibility, which I think (if Canadian law is anything like English and Australian) would lower the charge to manslaughter.
