Well anything throwing the term "abandonware" around is out, for starters.
Any site providing genuinely free (in any sense) games is almost certainly going to make the terms of the license(s) pretty obvious (at least in the cases of games which were originally not free), so that should be a fairly reasonable indicator. If the license isn't promoted in some way, I would be a little suspicious at the very least.
