I've heard it many times now, texting while driving is considered to be worse than drunk driving. That sucks for the neighbor Queue. R.I.P. I'm would be curious to find out what is going to happen to the driver. Yes, punish the idiots to the full extent of the law.

I don't drive much these days, but rather commute by bicycle. Indiana has a law on the books saying it's illegal for a cyclist to carry anything/partake in any activity that prevents both hands from being on the handlebars at all times.
I'm amazed there isn't a similar law for those operating much deadlier vehicles.

"OMG there is a new sale at... oh shit I just hit a dog or something, I'll message you later.."

I once had someone drive round me whilst I was crossing on a pedestrian crossing whilst they were on their phone, and they even gesticulated for me to get out of the way... Similarly to fett, I had to do a double-take, it was such bad driving.
Hope the driver gets time for this, 'tis really bad to text and drive. (
http://www.youtube.com/watch?v=t6NB51DR6y8) Patrick Stewart gave an example of stupid driving he's seen in the States on Top Gear, by the way.

The neighbor had gone out to get his mail, and some fucking cunt (God damn Soccer-Moms) came around the corner a little too fast, while typing out a text-message, and blasted him. Really blasted him hard--there's a greasy splat on the side of the road about 80 feet from the mailbox.
BAN AUTOMOTIVE LASER CANNONS.

I don't think it's a question of should it be illegal, rather why the hell isn't it illegal already? And I'm not talking about the "oh you're so bad, here's a $50 fine" type of illegal like a speeding ticker. Rather the three-strikes-you're out and we're suspending your license for 2 years because you're a fucking idiot type.
It'd take me two dozen sets of hands to count the time I've been cut off, almost sideswiped, watch a car swerve into incoming traffic, ect, because some idiot was driving with his elbows on the steering wheel so his hands could be free to text. And what's worse, is that an accident isn't usually enough to teach these people not to do it again.
Case in point, I've got a friend who was in a horrible accident about 7 years back. Took almost 8 million bucks in hospital bills, over a hundred surgeries, and months of painful physical rehab to get him back to normal. You'd think he of all people would be one to keep his undivided attention on the road. But oh no. He texts. He speeds. Usually at the same time. I hate driving with him, and I have to tell him off practically every time I get in the car with him. If that doesn't teach someone to keep both eyes on the road, then I think nothing short of taking a car away from someone is about the only option left for people.
Driving is a damn responsibility. People should treat it as such, or be forced to take the stinking bus to work everyday.

I'm for humanity before technology. Texting is a great tool, and cell phones are a great way to get directions, but to sacrifice the safety of myself or another human just to say "lol" to someone I probably hate anyway is completely idiotic.

In the uk, it's already an offense, and quite right too.
It was already an offence before they made up a new one for it, it was pretty well covered by inconsiderate, careless and dangerous driving. Either it's affecting their ability to drive with a reasonable amount of care and consideration or it isn't. That it's a phone in their hand causing them to not be paying attention should be irrelevant
