Guards confiscate stolen items only (which is actually really strange to me... how do they know they are stolen? :), so try to steal or picklock when you are not seen, also sneak when you do this to avoid detection ("Your crime has been reported" means there is bounty on your head for you have been detected). If your character has no idea about sneaking you can either train him a little or use "chameleon" spells or items containing this efect

Most people probably overlook it, why should you ever return to the starting village/room unless you're doing a mission (the usual way things are done in a crpg).

The Easiest Way is just to use your sneak ability and pick the dang lock. Even if the guard does catch you, kill him. Its only a 1040 bounty so you can get that taken care of for 510. No problem.

Thanks to everyone who responded to this thread with help. In the end I decided it was easier just to buy more copies of the stuff I'd lost....I would have slaughtered the guards but my character is too moral to kill innocent people (Fargoth excepted, of course) and I didn't want to get kicked out of the Legion. There didn't seem to be any way to pick the lock without getting noticed, and, as I said, as soon as I got caught, the chest re-locked itself.
I'm just gonna have to be more discreet in my Fargoth-baiting in future.....

this is just something i observed. If the things you stole you intend to enchant later on, their owneship changes to none. Plus i think its possible that the things you stole -an exquisite belt for example- you sell afterward, leaving nothing of the SAME(stolen exquisite belt) kind on or out in the world, the ownership tag dissappears - and so when you buy another exquisite belt legitimately(not the one u stole then sold) it would remain with the no owner tag.
as for sneaking, I have 100% chameleon out of 8 different articles of clothing and armor, and it is STILL possible to get detected (when sneaking). Make sure that you have no night eye active -since i noticed this somewhat aggreviate my sneaking skill- , and that you were holding the sneak key a bit longer and not moving at all for 3 to 5 secs -since this improves my chance to steal even when they're facing me-. 'course it gets kinda boring when you got 100 chameleon and 100 sneak skill, since everything is easy now.

Odd, my own experience is contrary to that... I hacked together a 100% chameleon, 70% night-eye ring (using the editor) and the only times I was noticed was when I was picking a lock or attacking someone. Even then, they were unable to locate me and wandered around screaming threats while trying to find me. Besides, Night-Eye doesn't increase the ambient light value, it increases your ability to see in the dark; I might buy that Light would decrease your Sneak value, but that's different.

Yup Night Eye effect should belike that, but since i dropped the Spear(illurok i think) with the CE Night Eye, i never get detected anymore. I experimented several times with same character against several NPCs with or without the Night Eye. "shrugs"

Just to add something on how I do the "evidenve chest".
It is very simple. Just kill the guard and then the old man, then walk up to a guard and pay your fine. Now walk back to the chest. There will be nobody in the room anymore.
