ok i am now up to next of kin quest with Dark Brotherhood faction... now i have done little else but Dark Brother hood... and i can't one shot the guy and i can't sneak into his house without getting caught... even when i kill the servant in one blow i still get arrested.. So if anybody can spoil this for me that would be great... or let me know what to do besides go out and climb some lvls... i think i am lvl 8 right now...

sneak up on him and kill him when he walks around. there is at least 4 places where no one can see. thats how i did it

Wait by the water where you can walk into with steps and he will come "take a bath" hide some were no one can see you nail him with the arrow and its over if you run out side and travel quit most the time they wont know who did it if they find ya go to jail or pay gold

I waited until he went for a swim, and shot him with the Rose from across the lake, out of sight from his bodyguard. His bodyguard just shrugged and walked off, it was kind of sad. ;)

I waded right into the pool, hit him with the arrow.. and ran out of the city with about 8 guards on my tail.
Two of them chased me for miles.. until they had an unfortunate encounter with daedra after following me into Oblivion.

umm, I think you guys are thinking about the quest where you have to kill the retired captain. "Next of Kin" is where you have to kill a bunch of family members around Cyrodiil, during the dead drop quests. From the sounds of it, you are trying to kill Matthias in Imperial City, which is a fairly difficult one. I personally would suggest taking time off from DB and master the Thieve's Guild. The Gray Fox Mask is an effective and powerful tool that really helps with many DB quests. Also the detect life is really useful for seeing through walls and plotting patrol routes. Personally, I killed Matthias by sneaking into his house, while the servant was looking away. This was luck and took a few tries. Then, I ran up the steps and snuck into his room. Put on the Gray Fox mask. And gutted the guy in his sleep.
The great thing about the mask is you become a new person with it on. I removed the mask, guard shows up and runs up to me. Since removing the mask removed my bounty, all he said was "Good Day, Citizen!". Then I was on my way. (you have to let the guard after you confront you, or else you cant fast travel.) I was able to pull the same thing with the Bartender, WHILE an imperial guard was facing me. Snuck behind the guy. Put on mask. Kill. Remove mask before guard reaches you. Talk to guard. Be on your merry way.
Well anyway, my suggestion is take some time off and GET THAT MASK! you will not regret it.
Edit: Not sure if this will work, but you could always try to place a poison apple on him if you have any left. I stocked up before i killed the DB merchant. I don't know when Matthias eats, though.

I guess you could say that, but you can't wear it in public, so that balances it.......slightly. However, it is a tool I am glad I have and make full use of it when I can. It also looks awesome on my Khajiit. the eyes dont quite line up, so instead the eye holes on the mask are pitch black.
