I disagree. Utilitarianism might seem like a good approach to punishment when you're talking about deterring lesser crimes, but as you move up the scale, and the harm caused by the crime intensifies and affects more people, the set of "morally acceptable" deterrents will expand to include punishing and torturing the criminal's spouse/children/friends/pets, even if they didn't know about the crime. Unless you're happy with doing that, it does matter whether you're personally responsible for your actions.

Also, clarify your opinion on the issue please StD. Are you now saying that diet is THE important factor, or that it's one of a number of things? I'd certainly go with the fact that a poor diet can alter behaviour. After all, all the big thighed vegitarians I know are just... lollingly dumb.
