So, a middle school teacher in Norwich, Connecticut is (http://www.norwichbulletin.com/apps/pbcs.dll/article?AID=/20070106/NEWS01/701060312/1002/NEWS17) facing up to 40 years in prison for the oh so hilariously phrased crime of "impairing the morals of a child." Why? (http://freestudents.blogspot.com/2007/01/julie-amero-was-scapegoat.html) because the school network had no firewall, no anti-virus, and no anti-spyware and the computer in her classroom got stuck in one of those porn pop-up loops. At best at this point this woman has lost her career, and at worst, the aforementioned 40 years in prison.

This shits gone too far, America. Janet Jackson boob hysteria was stupid, convicting a woman because the IT guy at her school is a fucking retard is INSANE.

I've read a little about this story before and I'm amazed that it managed to pass the laugh test, let alone make it to court.

It seems that the prosecution managed to get evidence from Herbert Horner of Contemporary Computer Consultants excluded as they hadn't been given full disclosure of his testimony.

The security community is apparently collectively (http://www.theregister.co.uk/2007/02/04/teacher_conviction/) working on more proof for the appeal.

There's no direct connection, but when I heard about this teacher I couldn't help but recall the (http://www.cnn.com/2007/US/01/31/boston.bombscare/index.html) two bozos in Boston who triggered a city-wide bomb scare, and think that America has really, really lost its way.

Yeah, I was shocked by the bomb-scare case too - I expected even our media to call the Boston folks a bunch of morons, but instead everyone seemed to blame the ad campaign for....uh....having boxes in their ads.

And this, well...even cynical-old-me can't imagine that this women will go to jail for 40 years. Also, WTF is with the jury trial? Most folks don't know jack shit about computer networks.

But isn't the problem figuring out whether it's a case where the illegal stuff has been involuntarily downloaded by some kind of virus or the person concerned has done it themselves? From what I read of this case that issue was put before the jury and they rejected that explanation. If that happens what can be done?

In these kinds of cases you need a well-prepared defence backed up by experts who have examined the computer and can say definitively that the illegal stuff was put there through no fault of the computer owner.
