It seems that the prosecution managed to get evidence from Herbert Horner of Contemporary Computer Consultants excluded as they hadn't been given full disclosure of his testimony.
The security community is apparently collectively (

Yeah, I was shocked by the bomb-scare case too - I expected even our media to call the Boston folks a bunch of morons, but instead everyone seemed to blame the ad campaign for....uh....having boxes in their ads.
And this, well...even cynical-old-me can't imagine that this women will go to jail for 40 years. Also, WTF is with the jury trial? Most folks don't know jack shit about computer networks.

But isn't the problem figuring out whether it's a case where the illegal stuff has been involuntarily downloaded by some kind of virus or the person concerned has done it themselves? From what I read of this case that issue was put before the jury and they rejected that explanation. If that happens what can be done?
In these kinds of cases you need a well-prepared defence backed up by experts who have examined the computer and can say definitively that the illegal stuff was put there through no fault of the computer owner.
